Terms of Service
1. Agreement
These Terms of Service (“Terms”) govern access to and use of the Vice Engine studio subscription platform, including websites, software, embeds, and related services (the “Service”). By creating a studio account, starting a trial, or using the Service, you agree to these Terms on behalf of the studio or business you represent.
2. Eligibility and authority
The Service is offered for business use by piercing studios and related professional studios in Canada and the United States only at launch. You represent that you are the studio owner or an authorized representative with authority to bind that studio to these Terms and to any subscription charges.
3. Accounts
You must provide accurate studio, business, and contact information and keep it current. You are responsible for safeguarding login credentials and for activity under your account. You must verify the email address used for the account before the studio dashboard is fully activated.
4. Free trial and automatic billing
New studio subscriptions may include a free trial period of thirty (30) days for the plan you select at signup. A valid payment method is collected at signup through our payment processor (Stripe). Unless you cancel before the trial ends, your subscription automatically converts to a paid plan and your payment method will be charged the then-current plan price when the trial ends, and thereafter on each billing interval until cancelled.
How to avoid being billed: You must cancel your subscription before the trial end date and time shown in Studio Account → Subscription. Stripe does not require a multi-day cancellation notice; cancellation completed before the trial ends prevents the first paid charge. Because billing occurs at the exact trial end time, we recommend completing cancellation at least twenty-four (24) hours before that timestamp. We also send a reminder email approximately three (3) days before the trial ends.
5. Plans, changes, and cancellation
Plan prices are shown at signup and in your account. You may change plans or update payment methods through the billing portal when available. You may cancel renewal or cancel before the trial ends from your account or the billing portal. Cancellation generally takes effect at the end of the current trial or paid period (`cancel at period end`), and you retain access until that time unless otherwise stated. Fees already charged for a completed paid period are generally non-refundable except where required by law or expressly stated by Vice Engine.
5A. Studio referral program
If you join using another studio’s permanent referral code, or if another studio joins using yours, the introductory discount and referrer account-credit rules in the Studio Referral Program apply. Those program terms include the 20% first-billable-month intro, 50% of amount-paid referrer credit, 14-day hold, stacking, void/reversal on refunds, and anti-abuse limits. Ops-assigned complimentary or promotional entitlements are separate from referral credits.
6. Studio data and customer data
You retain ownership of your studio content and customer operational data you submit. You grant Vice Engine a limited license to host, process, and display that data solely to provide and improve the Service. You are responsible for obtaining any consents required for customer information you collect through the Service and for complying with applicable privacy and consumer laws in your jurisdiction.
7. Acceptable use
- Do not misuse the Service, attempt unauthorized access, or interfere with other studios.
- Do not upload unlawful, infringing, or harmful content.
- Do not present health or piercing guidance as medical advice; professional anatomy approval remains required for services you perform.
- Do not resell platform access except as expressly permitted.
8. Service changes and availability
Vice Engine may modify features, suspend access for non-payment or abuse, or discontinue the Service with reasonable notice where practicable. Trial and beta features may change more frequently.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, VICE ENGINE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE ATLAS AND PLANNING TOOLS ARE EDUCATIONAL AND OPERATIONAL AIDS, NOT A GUARANTEE OF ANATOMICAL SUITABILITY OR CLINICAL OUTCOME.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VICE ENGINE’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO VICE ENGINE FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM. VICE ENGINE IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA.
11. Indemnity
You will defend and indemnify Vice Engine against claims arising from your studio operations, your customer relationships, your content, or your breach of these Terms.
12. Governing law
These Terms are governed by the laws applicable to the Vice Engine operating entity serving your region, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive venue, except where prohibited.
